SETTLEMENT TO THE CONSIGNOR As a Consignor I agree to offer quality items priced at around 25% - 30% of retail price. I will decide which items to sell at half price on the last day. But I may choose to discount none of them if I choose. I understand that as a Consignor with Rhea Lana's I will receive 70% of my total actual sales and will pay a participation fee. This participation fee will be automatically deducted from my check at the end of the sale. EXPLANATION OF GUARANTEE Rhea Lana's will guarantee items actually received (versus items input into the system but not checked in and offered for sale.) Rhea Lana's will guarantee either 1) the return of each unsold item or 2) payment for each unsold item which is not located and returned. This guarantee shall only apply to items which are not marked to be donated to Rhea Lana's and which are labeled with barcodes while at the store (see above.) Guarantee payments shall be made only after a thorough search is made for lost items. If items not belonging to a Consignor are accidentally misplaced with a Consignor's returned items, such Consignor is expected to return these misplaced items to Rhea Lana's when this discovery is made. LIABILITY FOR RECALLED ITEMS Rhea Lana's is aware and supportive of the current effort by the Consumer Product Safety Commission to remove recalled items from the resale industry. Rhea Lana's works hard to make consignors aware of the government's requirement not to sell recalled items and has assembled three large binders of recalled products which are readily available for consignors to check and look for matches among their items. Rhea Lana's initiative to organize children's resale sales events is a great practical advantage to consumer safety. Rhea Lana's provides an awareness and education of the efforts of the CPSC that families who own recalled items would not otherwise receive by holding their own garage sales. The recalled items culled from Rhea Lana's events would otherwise be sold (largely due to lack of awareness) at hundreds of garage sales scattered throughout the region. In addition to these procedures Rhea Lana's makes the recently published document, “Handbook for Resale Stores and Product Re-sellers“ available to all consignors with direct links on its website. Ultimately, Rhea Lana's provides a valuable service for individuals to consign their children's clothing, toys and maternity items. It is therefore my responsibility as Consignor not to consign and sell unsafe and recalled items. Each sale of my consigned items at Rhea Lana's is a transaction between me as the selling Consignor and the purchasing shopper. Rhea Lana's shall not be liable for the sale of unsafe or recalled items which are offered for sale, and I will indemnify Rhea Lana's from any claims of harm from my sold items. DONATED ITEMS Consignors have the choice of picking up unsold items or leaving selected items behind by donating such items to Rhea Lana's. Rhea Lana's is not a non-profit 501c(3) organization and such a choice by me as Consignor is therefore not a tax deductible donation. Consignors who wish to make tax deductible donations are advised NOT to click “Donate“ and to return on PICK UP DAY for their items and make donations directly to their selected charities. By clicking “Donate“ for an item on rhealana.com I acknowledge that this item will not be made available for return on PICK UP DAY, and this item will be under the sole control and possession of the owner of Rhea Lana's for his/her discretionary disposal. PICKUP DAY Items which are unsold and not marked “Donate“ will be re-sorted by consignor and available for return to the Consignor on PICKUP DAY. A check for the Consignor's share of the sales will also be available at that time. ITEMS LEFT DURING PICKUP DAY Rhea Lana's has a short term lease contract for its facility and must vacate the premises soon after the sale. Therefore, any items which are left at the store and not picked up by me on PICK UP DAY will join the Donated Items and shall be disposed of at the sole discretion of Rhea Lana's. DEFINITION OF CONSIGNORS “Consignors“ are individuals who provide or plan to provide items for sale at a Rhea Lana event and receive a percentage of the sales price for their items and work. Consignors include the individuals listed as the consignor in the records of Rhea Lana, Inc. as well as a member of the consignor's immediate family. The term consignors also includes children of consignors under 18 years of age who work under the direct supervision of and assist a parent or guardian who is a consignor in his or her duties at a Rhea Lana event, but such children may not work independent of or a part from the parent or guardian or under the direct supervision of any other person.
